This Privacy Policy explains how Porchway (“Porchway,” “we,” “us,” or “our”) collects, uses, and shares information when you use our website-building and lead-notification service (the “Service”).

2. Information We Collect

Information you provide directly:

  • Account and business information: name, business name, email address, phone number, business description, service area, hours, and any photos you upload.
  • Custom form content: any questions you create using our custom form builder.
  • Payment information: processed directly by our payment processor, Stripe. We do not directly store your full credit card number.

Information collected from your Page’s visitors:

  • When someone submits an inquiry through your Page’s contact form (standard or custom), we collect the information they provide (such as name, phone number, and their responses) in order to deliver it to you and store it in your client list, if applicable to your plan.

Information collected automatically:

  • Basic usage data, such as page views and form submission counts, to power the performance dashboard (Grow tier).
  • Standard technical information such as IP address, browser type, and device information.

3. How We Use Information

We use the information we collect to:

  • Create and operate your Page;
  • Notify you of leads and inquiries via text message and/or email, per your preference;
  • Process subscription payments;
  • Provide customer support, including admin-assisted account setup when requested;
  • Maintain and improve the Service;
  • Comply with legal obligations.

We do not sell your personal information or your Page visitors’ personal information to third parties.

4. SMS and Text Messaging Data

If you opt in to text notifications, we use your phone number solely to send you notifications related to activity on your Page. We do not use this number for marketing purposes unrelated to your account, and we do not share your phone number with third parties except as necessary to deliver the message itself (i.e., our SMS delivery provider, Twilio). You may opt out at any time as described in our Terms of Service.

5. How We Share Information

We share information only with:

  • Service providers who help us operate the Service, including Stripe (payment processing), Twilio (SMS delivery), and our hosting/application infrastructure provider. These providers are only permitted to use your information as necessary to provide their services to us.
  • Legal and safety purposes, if required by law, subpoena, or to protect the rights, safety, or property of Porchway, our Customers, or others.
  • In connection with a business transfer, such as a merger, acquisition, or sale of assets, subject to standard confidentiality protections.

6. Data Retention

  • We retain your account and Page data for as long as your account is active.
  • If you downgrade your plan, data associated with features not included in your current plan is retained, not deleted, and will be restored if you upgrade again.
  • If you cancel your account entirely, we retain your data for [INSERT PERIOD, e.g., 90 days] in case of reactivation, after which it will be deleted, except as required for legal, tax, or accounting purposes.

7. Your Rights and Choices

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children’s Privacy

The Service is intended for use by business owners who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we become aware that we have inadvertently collected such information, we will take steps to delete it.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy with a new effective date, and material changes will be communicated to you as described in our Terms of Service.
